Please join us for a CLE presented by Professor Thomas C. Galligan Jr. “Continued Conflation Confusion in Louisiana Negligence Cases: Duty and Breach” at the LBA Office on September 29th, 2022 from 4-5 p.m.

The presentation will cover the tendency of courts to combine the issues of duty and breach in negligence cases and the challenges that combination presents. Professor Galligan will discuss the “overparticularization” of the duty to exercise reasonable care; the overreliance on facts in analyzing duty; the flaws in Louisiana’s “open and obvious” doctrine; and the fact that turning breach into jury takes power away from the factfinder.
